This privacy policy explains how Paisley handles your personal information and data, and applies to all of the products, services and websites offered by Paisley Holdings, Inc. (“Paisley”), except where otherwise noted. Paisley products, services and websites are collectively referred to as the “Services” in this policy.


In this policy, “you” refers to those who use and/or interact with any or all of our products, services, and websites, and “we”, “us”, and “our” refer to Paisley. “Customer”(s) refers specifically to those who use Paisley’s services. “Form Responders” refers to those who fill in and/or submit forms used by our Customers.


What Information Do We Collect

From Our Customers


We collect personal data that you provide to us, either by creating a Paisley account, using the website, submitting ‘Contact Us’ forms, or otherwise interacting with us (like at conferences and trade shows).


Account Creation Information


When you create an account with us so you can create and/or use forms, we collect your username, password and email address.


Billing information


If you make a payment to Paisley, we require that you provide your billing details, including name, address, email address and financial information corresponding to your selected method of payment (e.g. a credit card number and expiration date or a bank account number). If you provide a billing address, we will regard that as the location of the account holder. Our integrations with third party payment gateways are for processing only. We don’t store or log any sensitive cardholder data provided by you or your form users. Paisley will maintain all applicable PCI DSS requirements to the extent we handle, have access to, or otherwise store, process, or transmit the customer's cardholder data or sensitive authentication data, or manage the customer's cardholder data environment on behalf of a customer.


Account settings


Our customers can set various preferences and personal details on pages, such as your account settings page. For example, your default language, timezone and communication preferences (e.g. opting in or out of receiving marketing emails from us).


Form data


We store our customers’ form data (form fields and input and data inputted in those fields), in some cases using third party server providers such as Amazon Web Services and Google Cloud.


Data you use to create forms is owned by you


We treat your forms as private, unless you make them available to members of the public. We don’t sell or make forms you’ve created available to anyone, nor do we use the form responses you collect, for purposes unrelated to you or our services, except in a limited set of circumstances (e.g. if we are compelled by a subpoena or court order, or if you’ve given us permission to do so).


Paisley safeguards responders’ email addresses


To make it easier for you to invite people to complete your forms via email, you may upload lists of email addresses, in which case we act as a mere custodian of that data. We don’t sell these email addresses or make them available to others except as directed by you and in accordance with this policy. The same is true for any email addresses collected through your forms.


Paisley holds your data securely


We implement appropriate security controls to protect PII from unauthorized access, use, disclosure, modification, or destruction. These controls may include encryption, access control, and intrusion detection and prevention systems.


From Form Responders


When you fill in or complete a form used by one of our Customers, we collect information relating to you and your use of our services:


Form responses


We collect and store the form responses that you submit, in some cases using third party server providers like Amazon Web Services or Google Cloud, on behalf of our Customers. The form creator/provider (Customer) is responsible for this data, and they manage it. A form may ask you to provide personal information or data. If you have any questions about a form which a Customer has sent to you or given you access to fill in, or about the data to be provided in the form, please contact the Customer directly, since Paisley is not responsible for the content of that form. The Customer may have their own privacy policy.


From Visitors to Our Websites

Usage data


We collect usage data when you interact with our services. This may include which web pages you visit, what you click on, when you performed those actions, and so on. Additionally, like most websites today, our web servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of each access, including originating IP addresses, internet service providers, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system versions, and timestamps.


Device data


We collect data from the device and application you use to access our services, such as your IP address, operating system version, device type, system and performance information, and browser type. We may also infer your geographic location based on your IP address.


Referral data


If you arrive at a Paisley website from an external source (such as a link on another website or in an email), we record information about the source that referred you to us.


Information from third parties


We may collect your personal information or data from third parties, if you have given permission to those third parties to share your information. Information from page tags. We use third party tracking services that employ cookies and page tags (also known as web beacons) to collect aggregated and anonymized data about visitors to our websites. This data includes usage and user statistics. Emails sent by Paisley or by users through our services may include page tags that allow the sender to collect information about who opened those emails and clicked on links in them. We do this to allow the email sender to measure the performance of their email messaging and to learn how to improve email deliverability and open rates.


Cookies


Paisley uses cookies and similar technologies to provide and support our websites, applications, services, and tools. Cookies are small text files sent by us to your computer or mobile device. They are unique to your account or your browser. Session-based cookies last only while your browser is open and are automatically deleted when you close your browser. Persistent cookies last until you or your browser delete them or until they expire. Paisley uses cookies and similar technologies like single-pixel gifs and web beacons. We use both session-based and persistent cookies. Paisley sets and accesses our own cookies on the domains operated by Paisley and its corporate affiliates (collectively, the “Sites”). In addition, we use third party cookies, like Google Analytics.


How we use information


Paisley may access and use Customer Data as reasonably necessary and in accordance with Customer instructions to provide, maintain, and improve the Services. We may use your Customer Data to provide Support. We may use your Customer Data to address security, service, and/or technical issues. We may use your Customer Data to communicate with you. We may use your information to market our services to you. We may use your Customer Data to prevent fraud and generally stop ‘bad things’ from happening. Finally, we may use your Customer Data as required by law or when expressly permitted in writing by the Customer.


The Privacy Policy is not intended to place any limits on what we do with data that is aggregated or anonymized so that it is no longer associated with you as the Customer.


Security


Paisley takes great care to protect your data and security is job one. We implement a variety of security measures to maintain the safety of your personal information when you place an order.


We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment Gateway Providers Database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.


We take various steps to protect information you provide to us from loss, misuse, and unauthorized access or disclosure. These steps take into account the sensitivity of the information we collect, process and store, and the current state of technology.


Children Under the age of 13 (COPPA)


We do not knowingly collect any information from children under the age of 13 unless a Customer has provided authorization and consent for a student under age 13 to use our products or services. If a Customer requests that students use our software (such as completing a form sent from a School), we collect, process, and retain such information solely to provide educational services to the Customer and for the purposes set forth in our agreement with the Customer. The Customer has complete control over the data. The Customer may access the data, delete the data, or withdraw consent regarding the student’s information at any time. This section only applies to children under the age of 13 and supplements the other provisions of this privacy policy.

California Privacy Rights


The California Consumer Privacy Act (“CCPA”) allows California residents, upon a verifiable consumer request and subject to applicable exemptions, to request that we give you access, in a portable and (if technically feasible) readily usable form, to the specific pieces and categories of PII that we have collected about you, the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared. California residents also have the right to submit a request for deletion of information under certain circumstances. Paisley will not discriminate against you for exercising your rights, such as by denying you services, charging you different prices for services, or providing you a different level or quality of services. Please note that you must verify your identity and request before further action will be taken. As part of this process, we may require you to provide government identification. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification.We do not sell your PII to third parties. We do, however, share PII with third parties for the business purposes described in this Policy.California law also permits our customers who are California residents to request and obtain from us once a year, free of charge, information about the PII (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year.If you are a California resident and would like to exercise your data protection rights, where applicable, you can submit a request using our online form (available here) or contact us through Paisley’s Mobile App or [email protected] will consider all requests and provide our response within a reasonable period of time (and within any time period required by applicable law). Please note, however, that certain information may be exempt from such requests, for example, if we need to keep the information to comply with our own legal obligations or to establish, exercise, or defend legal claims.


Sharing and Disclosure of Information

1. Customer Data


Paisley may share Customer Data in accordance with our agreement with the Customer and the Customer’s instructions, including:


  • With third party service providers and agents. We may engage third party companies or individuals to process Customer Data.

  • With affiliates. We may engage affiliates in our corporate group to process Customer Data.

2. Other information

Paisley may share other information as follows:


  • About you with the Customer. There may be times when you contact Paisley to help resolve an issue you may be having. In order to help resolve the issue and given our relationship with our Customer, we may share your concern with our Customer.

  • With third party service providers and agents. We may engage third party companies or individuals, such as third party payment processors, to process information on our behalf.

  • With affiliates. We may engage affiliates in our corporate group to process other information.

3. Other types of disclosure

Paisley may share or disclose Customer Data and other information as follows:


  • During changes to our business structure. If we engage in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Paisley assets, financing, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities (e.g. due diligence).

  • To comply with laws. To comply with legal or regulatory requirements and to respond to lawful requests, court orders and legal process.

  • To enforce our rights, prevent fraud and for safety. To protect and defend the rights, property, or safety of us or third parties, including enforcing contracts or policies, or in connection with investigating and preventing fraud.

We may disclose or use aggregate or anonymized information for any purpose. For example, we may share aggregated or de-identified information with our partners or others for business or research purposes like telling a prospective Paisley Customer the average number of requests made within PermitDirector in a day or partnering with research firms


Changes to our Privacy Policy


We may change this policy from time to time, and if we do we will post any changes on this page. If you continue to use the Services after those changes are in effect, you agree to the revised policy.
